Terms and Conditions:

Evac Americas Corporation (“EAC”) offers memberships providing prepaid protection against aero medical transport costs not covered by a member’s insurance or medical benefits, subject to the following terms and conditions:

1. Patient transport by EAC will be to Panama City for medical conditions determined by EAC’s flight doctor to be life- or limb-threatening, or that could lead to permanent disability, and which requires air medical transport. Ground ambulance in Panama City transports to the hospital of patient’s choice. A patient’s medical condition, not membership status, will dictate whether or not air transportation is appropriate and required. Under all circumstances, EAC retains the sole right for determining whether or not a patient is flown.
    
2. EAC services may not be available when requested due to factors beyond EAC’s control, such as use of the appropriate aircraft by another patient or other circumstances governed by operational requirements or restrictions including, but not limited to, equipment manufacturer limitations, governmental regulations, maintenance requirements, war, acts of terrorism, natural disasters, or weather conditions. The primary determinant of whether to accept a flight is always the safety of the patient and flight crew.
    
3. EAC reserves the right to bill directly the appropriate insurance or benefits provider for services rendered, and members authorize their insurer or benefits provider to pay any covered amounts to EAC directly. Members agree to remit to EAC any payment received from insurance or benefit providers for air medical services provided by EAC, not to exceed regular medical charter charges. EAC is not an insurance company and memberships are not insurance policies nor can they be considered as a secondary insurance coverage or a supplement to any insurance coverage. EAC will not be responsible for payment for services provided by another transport or ambulance service. Member’s only payment to EAC is the Membership fee.
    
4. Resident membership begins at midnight on the Fifteenth (15) calendar day after EAC receives a complete sign-up form with full payment. Tourist memberships start upon arrival in Panama if purchased before arrival. If purchased in Panama, Tourist membership coverage begins after 48 hours from time of purchase.
    
5. Memberships are non-refundable and non-transferable. EAC reserves the right to reject or revoke membership at anytime, without reason. All Members must have valid residency or tourist documentation as required by the Republic of Panama. Members who do not have valid documentation may be denied service or will be charged the full medical charter rate for flights.
6. Resident membership allows three (3) flights per year, per member. Tourist membership allows one (1) flight per ninety (90) day period. Resident Child Memberships are for children up to and including age 17.
    
7. EAC, and it’s partners, are not responsible for any negative effects on a patient’s condition as a result of the effects of transportation by aircraft, including death.
    
8. These Terms and Conditions supersede all previous terms and conditions between a member and EAC, including any other writings, or oral representations, relating to the terms and conditions of membership.
    
9. EAC Membership Terms and Conditions become binding after payment is received. Member’s payment acknowledges acceptance of these Terms and Conditions.
    
10. EAC Membership Terms and Conditions are subject to change at any time without notice. Changes are first published on EAC’s website, sent via email, and or published in newspapers or other advertising.
